In criminal law usually only individuals get a punishment and not an organization. There are some exceptions if an individual can't be found or a criminal responsibility of persons can't be proved but there’s a criminal act. Such cases concern usually only companies.
Therefore, Ergenekon can't be the defendant in this case.
